Phoenix, Arizona—O’Steen & Harrison has served a notice of claim against the State of Arizona in connection with a fatal crash on US-93 that claimed the life of Cambrell Price.

On February 3, 2022, at about 6:53 p.m., Mr. Price was a passenger in a vehicle driven by Latisha Ladell and proceeding northbound on US-93 in White Hills, Arizona near milepost 29.8. A semi-truck driven by Eric Maynard (Panther II Transportation) attempted to exit the TA Express Truck Stop located at 19210 US Highway 93 by crossing the northbound lanes of US-93. Mr. Maynard intended to execute a left turn to proceed southbound on US-93 by driving over the paved median crossover that separated the northbound lanes from the southbound lanes.

In order to legally enter the southbound lanes of US-93, Mr. Maynard would be required to first stop at a stop sign marked with a stop bar before he could initiate the left turn onto the highway. The paved median crossover was not wide enough to accommodate the length of the tractor-trailer. The trailer was blocking the northbound lanes of US-93 when the vehicle occupied by Mr. Price crashed into the rear axle. The intersection does not have traffic lights to govern vehicles on the US-93 or exiting the TA Express Truck Stop.

The Notice of Claim against the State of Arizona alleges that the State failed in its to duty to design, construct and maintain a safe roadway. As a crossover designed to facilitate traffic exiting a truck stop, the State should have built the crossover with sufficient width to accommodate tractor-trailers without blocking the northbound lanes of US-93.

Crash statistics reveal that at least five fatal collisions occurred at this crossover between December 18, 2020 and December 14, 2022, according to the Notice of Claim. Other injury crashes occurred at this same location during that time period. ADOT has not yet released crash statistics for 2023.

Jonathan O’Steen, one of the attorneys for Mr. Price’s children, states:

The design of this roadway is patently dangerous, and it is shocking that ADOT and the State of Arizona have done nothing to fix the roadway, even when faced with a staggering number of serious and fatal crashes. Mr. Price’s young children deserve accountability for the crash that killed their father.

US-93 is a notoriously unsafe highway and inspired the Facebook page “US 93 AKA “Bloody Alley,” which boasts more than 5,800 members.

The Notice of Claim was brought on behalf of Mr. Price’s three children. A Notice of Claim is a prerequisite to filing a lawsuit against State of Arizona. Claims against Mr. Maynard, Panther II Transportation, and Ms. Ladell are proceeding in Maricopa County Superior Court. See Price v.
